Alabama Supreme Court Chief Justice Roy Moore plans to appeal an 11th U.S. Circuit Court of Appeals ruling that the 2½-ton Ten Commandments monument should be removed from the Alabama Judicial Building.
In an opinion written by U.S. Circuit Judge Ed Carnes of Alabama, the three-judge court said the monument violates the Establishment Clause of the U.S. Constitution that forbids the promotion of religion by the government.
Moore placed the monument in the rotunda of the judicial building the night of July 31, 2001. He acted without the advance approval or knowledge of the other eight justices of the Alabama Supreme Court after winning election in 2000 as "The Ten Commandments Judge," the opinion said.
Moore said the monument depicts the moral foundation of the law, and no public funds were used on it.
